#Snowpack news: The SW basins are still way above average

According to data from the Natural Resources Conservation Service (NRCS) the San Miguel, Dolores, Animas and San Juan River basins have a reported snowpack total of 160 percent of median this week — an increase from last week’s total of 152 percent of median…

The Upper San Juan site is currently sitting at 130 percent of median, an increase from last week’s total of 127 percent of median.

The Upper Rio Grande Basin snowpack total remains at 137 percent of median.

For the Arkansas River Basin, a 6 percent increase was reported, with snowpack totals going from 129 percent of median to 135 percent of median this week.

The Yampa and White River basins saw a 7 percent increase in the snowpack total, going from 110 percent of median to 117 percent of median this week.

The Laramie and North Platte River basins report a 6 percent increase, with totals going from 113 percent of median to 119 percent of median.

For the South Platte River Basin, a 4 percent increase was reported, with snowpack totals going from 112 percent of median last week to 116 percent of median this week.

The Upper Colorado River Basin is 131 percent of median this week, when last week it was 123 percent of median.

Lastly, the Gunnison River Basin jumped 6 percent from last week, going from 142 percent of median to 148 percent of median this week.

The Wolf Creek summit was 127 percent of the April 17 peak and 124 percent of the median peak. Last week, the summit was 139 percent of the April 10 peak and 132 percent of the median peak.

According to the National Weather Service (NWS), there are no reports of snow on the hori- zon for Pagosa Springs; however, the NWS does indicate a chance of thunderstorms on Sunday…

NRCS District Conservationist Jerry Archuleta explained that it’s good to see the local snowpack totals staying flat.

“So, that means we’re holding that snow up there a little bit longer,” he said.

Groundwater levels during 2018, on average, rose slightly or remained about even throughout most of western and central Kansas, according to preliminary data compiled by the Kansas Geological Survey.

“By and large, 2018 was a good year for groundwater levels,” said Brownie Wilson, KGS water-data manager. “Virtually all levels in south-central Kansas wells were up along with a good portion of those in northwest Kansas, and although southwest Kansas saw a few decline areas in the usual spots, they were not as great as in years past.”

The KGS, based at the University of Kansas, and the Kansas Department of Agriculture’s Division of Water Resources (DWR) measure more than 1,400 water wells in Kansas annually. Most of the wells are drilled into the High Plains aquifer, a network of water-bearing rocks underlying parts of eight states and the state’s most valuable groundwater resource.

Ninety percent of the collected data comes from wells tapping the aquifer. The other wells are drilled into other aquifers underlying the High Plains aquifer and shallow aquifers adjacent to surface-water sources, such as the Arkansas River. Most of the 1,400 wells have been measured for decades.

In Kansas, the High Plains aquifer comprises three individual aquifers—the widespread Ogallala aquifer that underlies most of the western third of Kansas, the Equus Beds around Wichita and Hutchinson, and the Great Bend Prairie aquifer around Pratt and Great Bend.

Water levels in the Ogallala aquifer are influenced mainly by the amount of water withdrawn each year, which in turn is affected by the rate and timing of precipitation. Recharge, or water seeping down from the surface, adds little groundwater to the Ogallala. In central Kansas, however, recharge has more of an impact because the Equus Beds and Great Bend Prairie aquifer are shallower and average precipitation in that part of the state is higher.

Most of the wells in the network monitored by the KGS and DWR are within the boundaries of the state’s five Groundwater Management Districts (GMDs), which are organized and governed by area landowners and local water users to address water-resource issues.

In Southwest Kansas GMD 3, average levels dropped .39 feet. Although down, the change was less than in 17 of the last 20 years when levels fell between .5 and 3.5 feet annually. A rise of .05 feet in 2017 was the only positive movement during that time.

For the second summer in a row, water flowed for a time from the Colorado state line to Garden City. The river, which interacts with its adjacent shallow alluvial aquifer, has been mainly dry in western Kansas for decades.

Wells monitored in GMD 3 are drilled into the Ogallala aquifer except in a few areas where they draw from the deeper Dakota aquifer. The district includes all or part of Grant, Haskell, Gray, Finney, Stanton, Ford, Morton, Stevens, Seward, Hamilton, Kearny and Meade counties.

Western Kansas GMD 1 experienced a slight drop of .18 feet following a slight gain of .07 feet in 2017. The GMD includes portions of Wallace, Greeley, Wichita, Scott, and Lane counties, where the majority of wells are drilled into the Ogallala aquifer.

“West central was basically unchanged as a whole but the average is bookended by declines in Wallace County and rises in Scott County,” Wilson said.

Northwest Kansas GMD 4 had an average increase in water levels of .26 feet following a rise of .38 feet in 2017. GMD 4 covers Sherman, Thomas, Sheridan and parts of Cheyenne, Rawlins, Decatur, Graham, Wallace, Logan and Gove counties. Groundwater there is pumped almost exclusively from the Ogallala aquifer and shallow alluvial sources associated with streams. Besides being influenced by precipitation, water-level results in part of GMD 4 were tied to crop loss.

“Some producers south of the Goodland to Colby area got hailed out early in the 2018 growing season,” Wilson said. “With hail damaged crops and higher precipitation rates in the eastern portion of GMD 4, wells there had less declines or even slight recoveries.”

Big Bend GMD 5 had an average increase of 1.21 feet following an increase of .30 feet in 2017. The GMD is centered on the Great Bend Prairie aquifer underlying Stafford and Pratt counties and parts of Barton, Pawnee, Edwards, Kiowa, Reno and Rice counties.

Equus Beds GMD 2, a major source of water for Wichita, Hutchinson and surrounding towns, experienced a gain of 1.35 following a 1.93-foot decline in 2017. The GMD covers portions of Reno, Sedgwick, Harvey and McPherson counties.

The KGS measured 581 wells in western Kansas and DWR staff from field offices in Stockton, Garden City and Stafford measured 223, 260 and 357 wells in western and central Kansas, respectively. Measurements are taken annually, primarily in January when water levels are least likely to fluctuate due to irrigation.

The results are provisional and subject to revision based on additional analysis. Data by well is available at http://www.kgs.ku.edu/Magellan/WaterLevels/index.html.

@USBR expects above average #runoff on the #RioGrande through #NewMexico this Spring

Irrigators, municipalities, recreation community and the overall ecosystem of the Rio Grande will experience the benefits of an above average spring runoff this year. That’s according to the Annual Operating Plan based on above average snowpack in the mountains that feed the Rio Grande and its tributaries released today by the Bureau of Reclamation and U.S. Army Corps of Engineers.

The Natural Resources Conservation Service’s April streamflow forecast predicts that Rio Chama flow into El Vado Reservoir will be 142% of average, up from just 18% of average last year. This is a forecast inflow of approximately 320,000 acre-feet, up from 41,000 acre-feet at the same time last year. Rio Grande streamflow at Otowi Bridge is similarly predicted to be at 142% of average.

“This is a complete turnaround from last year when we were preparing for drying in the Middle Rio Grande in April,” said Reclamation’s Albuquerque Area Office Manager Jennifer Faler. “We are looking forward to a good spring runoff that will improve storage supplies and help the endangered Rio Grande silvery minnow spawn. Reclamation will continue to work closely with our water management partners at the U.S. Army Corps of Engineers, State of New Mexico, Bureau of Indian Affairs and irrigation districts to manage the Rio Grande safely and efficiently through the summer.”

The Rio Grande is currently operating under the Rio Grande Compact’s Article VII restrictions. Under Article VII when the combined usable Rio Grande Project storage in Elephant Butte and Caballo is below 400,000 acre-feet, storage in upstream reservoirs, like El Vado, is only allowed under limited circumstances. Reclamation expects Article VII restrictions to end in mid-May for several months, allowing for storage in El Vado during that time. Elephant Butte and Caballo Reservoirs ended the last irrigation season holding less than 3% of their combined storage capacity. They are already rebounding and are currently holding more than 288,000 acre-feet or about 13% of capacity.

The Elephant Butte Irrigation District, El Paso County Water Improvement District Number One and Mexico plan to begin irrigation the first week in June. Reclamation will begin releasing water from Elephant Butte to Caballo Reservoir on May 3 in preparation for the irrigation season. Releases from Caballo will begin on May 31. The dry riverbed between Elephant Butte and Caballo and below Caballo will take on water quickly. As such, it will be both unpredictable and very dangerous. The public is asked to stay out of the river channel for their safety.

Governor Polis signs long bill (budget)

Governor Jared Polis today signed SB 19-207, FY 2019-20 Long Bill, into law. He was joined by sponsors and Joint Budget Committee members Senator Dominick Moreno and Representative Daneya Esgar. The budget funds top priority items including free full-day kindergarten, saving people money on health care, and investments for water and transportation.

SB19-207 establishes an operating budget of $31.9 billion total funds of which $11.8 billion is General Fund.

“This budget lays a strong foundation for a bold vision for our state, creating opportunity for all,” Governor Polis said. “A product of collaboration and teamwork with Colorado’s leaders in the General Assembly, this budget ensures that our state’s economic success can be realized by every child, adult, and business in our communities. My top priority in this first year as Colorado’s 43rd Governor was to provide access to free, full-day kindergarten to every Colorado family. I am proud to say that this budget makes that vision a rapid reality, with funding now available for the school year that starts this fall.”

Colorado Gov. Jared Polis has signed into law a $30.5 billion state budget for the fiscal year that begins July 1.

Colorado Politics reports Polis signed the document on Thursday, his 100th day in office.

The budget includes $175 million to offer free full-day kindergarten throughout the state, a top Polis priority.

Tuition at Colorado’s public colleges and universities won’t rise in the 2019-2020 school year. Transportation needs get an extra $300 million. And state employees will receive a 3% pay hike.

Fish passage begins its work reconnecting Poudre River segments

Construction crews have completed a new fish passage along the Poudre River at Watson Lake State Wildlife Area northwest of Fort Collins.

Built with the cooperation of the participants of the Northern Integrated Supply Project, Colorado Parks and Wildlife, noosa yoghurt and Morning Fresh Dairy, the passage serves to reconnect stretches of river that had been separated by a diversion dam.

Fort Collins company OneFish Engineering designed the project, and the construction company L4 Environmental built it over the past four months.

A dedication ceremony for the new structure is planned for early May. The Poudre Heritage Alliance and Trout Unlimited are also providing assistance, and a public celebration for the new passage is planned during the Pleasant Valley Rendezvous on June 2 at Watson Lake.

Summary

Two rapidly-moving strong storm systems, one “bombing out” in the central Plains during mid-week while a second storm intensified over the middle Mississippi Valley during the weekend, brought severe weather and widespread precipitation to many areas of the lower 48 States, including heavy snows to parts of the north-central Rockies, north-central Plains, and western Great Lakes region. In the Northwest, moderate precipitation falling on an unseasonably late (and above-normal) mountain snow pack (due to a minimal melt from a cold spring) produced near- to record high stream flows in much of Oregon and southern Washington. Widespread precipitation, including mountain snows, fell across Idaho, Montana, northeastern Nevada, Utah, and Wyoming. In the Plains, moderate to heavy rains (1-3 inches) were measured in the south-central sections (Oklahoma and Texas), which then moved into the lower Mississippi and Tennessee Valleys (up to 6 inches in northern Louisiana). To the north in colder air, South Dakota was buried under heavy snow (locally over 2 feet). Moderate to heavy snows also blanketed Minnesota, Wisconsin, northern Michigan, and northern Illinois. Meanwhile, light to moderate precipitation was measured in the eastern third of the Nation, with a stripe of heavier rainfall (1.5-3 inches) falling from northern Georgia northeastward into southern New England. In contrast, most of the Southwest, extreme southern, central, and extreme northern Plains saw little or no precipitation. Temperatures generally averaged below-normal in the western two-thirds of the U.S., especially in the northern Plains and upper Midwest (6 to 12 degF), and above-normal in the eastern third of the Nation (6 to 9 degF in the Carolinas)…

High Plains

The mid-week storm system tracked out of the Northwest and into Wyoming, finally dropping decent precipitation (including heavy snow) across much of the state before it moved eastward into South Dakota (up to 26 inches), southern Minnesota (nearly a foot), and central Wisconsin (to 10 inches) by Friday. Liquid equivalents of 1-3.5 inches fell across central Wyoming and much of South Dakota, which was welcome for Wyoming as drier conditions had prevailed there before this week. The storm increased the WYTD basin average precipitation and SWE in Wyoming, with some basins now with WYTD surpluses. Accordingly, a 1-cat improvement was made in central Wyoming where the heaviest totals occurred and WYTD surpluses existed. In northwest Montana, 1-3 inches of precipitation in northwestern Teton, western Ponderosa, and southwestern Glacier Counties was enough to remove D0 as WYTD precipitation and SWE edged above 100% on April 16. Decent precipitation also fell on northwestern Montana (Lincoln County), but longer-term deficits lingered, and D0(L) remained. In Colorado, some scattered precipitation (0.25-1 inches) fell on southern D0 and drought areas, but it was not enough for additional improvements. Drier weather prevailed in Kansas and eastern Nebraska, but that was welcome after wet and cold weather earlier this spring…

West

Two storm system brought moisture to most of the Pacific Northwest, northern Rockies, and southward into northeastern Nevada and most of Utah. In the Pacific Northwest (mainly Oregon and Washington), this week’s precipitation + late-season snow melt = record high stream flows (flooding), even though WYTD was below-normal in northern areas, and long-term drought (more than 1 year) lingered in some Pacific Northwest areas. Fortunately, reservoirs were filling with the high stream flows, and were expected to rise to normal levels. Accordingly, improvements were made where 12-month SPEIs were normal to wet, precipitation fell this week, and WYTD surpluses existed. Thus, D0 was removed along the southern & eastern edges in Oregon, in central Washington’s Grant & Kittitas Counties, and D1 was shrunk (western edge) in the northern Cascades where 2-5 inches of precipitation fell. In Utah, the same storm system dropped 1-3 inches of precipitation in northern and central Utah, bumping WYTD basin average precipitation to 130-150% and SWE to 150-180% of normal as of April 16. 12-month SPEIs are normal or even wet, thus the western edge of D1 was shrunk and D0 erased thru central Utah. Little or no precipitation fell across the Southwest, but with late winter and spring surplus precipitation, generally below-normal temperatures this year, and mostly WYTD precipitation surpluses, no changes were made in California, Arizona, New Mexico, and Colorado…

South

With the mid-week (first) storm system mainly impacting areas farther north, the second system that occurred during the weekend developed and rapidly intensified over the southern Plains and lower Mississippi Valley. Widespread moderate to heavy rains (2-4 inches, locally to 6 inches), including numerous reports of severe weather that took several lives, soaked parts of the South, resulting in 1-cat improvements in southwestern and southeastern Oklahoma, northern and central Texas, central Louisiana, and southwestern Mississippi. Arkansas, Tennessee, and northern Mississippi also received abundant rains and remained drought free. In contrast, the rains missed southern sections of Texas and Louisiana, leading to status-quo or some slight D0-D1 expansion. The small D0-D1 area in southwestern Louisiana was shifted southward to better line-up with the driest short-term conditions…

Looking Ahead

During the next 5 days (April 18-22, 2019), another strong storm system will impact the eastern half of the Nation, bringing heavy rains (2-3 inches) and possible severe weather to the Tennessee, Ohio, and lower and middle Mississippi Valleys and the East Coast. Unsettled weather will also impact the Northwest, Rockies, and most of the Plains, although precipitation totals will be much lower. Temperatures will average above-normal across much of the contiguous U.S., with closer to normal readings likely in the Southeast.

The CPC 6-10 day extended range outlook (April 23-27, 2019) favors above-normal precipitation from the Rockies eastward to the Appalachians and in southern and eastern Alaska, with the strongest probabilities over the southern Plains and the lower Mississippi Valley. Below-normal precipitation odds are likely in California. Above normal temperatures are favored for much of the lower 48 States, while Alaska is expected to see below-normal readings.

The Ogallala Water Coordinated Agriculture Project update

The Ogallala Water Coordinated Agriculture Project brings together 70 researchers, along with specialists and students based at seven universities and two USDA research locations…

OWCAP involves research, demonstration and education. The University of Nebraska-Lincoln’s Water Resources Field Laboratory near Brule is one of the research sites.

The TAPS competition at North Platte is also part of OWCAP. TAPS stands for Testing Ag Performance Solutions. A highly respected and innovative program, TAPS is made up of miniature corn and grain sorghum “farms,” where individuals and teams make decisions such as when and how much to irrigate, and how much nitrogen fertilizer to use. Participants earn awards for efficiency and profitability.

UNL water management specialist Daran Rudnick is an active member of the OWCAP research team. He worked with other educators at the West Central Research and Extension Center at North Platte to implement TAPS three years ago.

OWCAP is about identifying and promoting practices that conserve water and prevent water pollution, said OWCAP Manager Amy Kremen, who is also a water expert at Colorado State University.

Sharing ideas is an important part of OWCAP. For example, TAPS is now expanding in coordination with Oklahoma State University to offer a sprinkler-irrigated corn competition at Guymon, Oklahoma, this year.

OWCAP participants in Texas have something to share, too. The Natural Resources Conservation Service and North Plains Groundwater Conservation District there have implemented a master irrigator program that involves intensive training and certification. Now other states are considering implementing similar programs, Paulman said. Programs like that help increase adoption of water conserving practices, he said.

OWCAP has also resulted in research projects that each span three or more states, Kremen said. That “helps us to draw broader conclusions” about the potential of water conservation practices.

Those practices include making effective use of soil moisture sensors and aerial photography to inform irrigation and fertilizer decisions, carefully timing irrigation based on crop growth stages, using university-supported irrigation scheduling tools, and transitioning successfully to dryland…

OWCAP has also resulted in publication of over 50 peer-reviewed journal articles and other reports, which are available at ogallalawater.org.

Kremen said the OWCAP team is on track to complete its USDA-NIFA funded work within the next two years. Team members are the lead organizers for a summit to take place in early 2020 in Amarillo, Texas. There, water management leaders from throughout the region will share their experiences and findings in hopes of benefiting agricultural producers and communities throughout the region.

The civil rights movement leaders of the 1960s had no idea that school-shooting survivors from one of the most southern points in the U.S. would lean on their teachings to power a modern nonviolent movement to end gun violence. Students around the world began standing up for their survival, leaning only on the fire inside them to prevent the pain they understand too intimately.

Greta Thunberg saw her power in us, and we in turn see our power in her. Fighting in her home country, Sweden, for a future free from pollution, environmental degradation and climate change, Greta is inspiring steadfast students and shaming apathetic adults.

She realized early on that the powers that be would be stacked against her and her mission, stating, “We can’t save the world by playing by the rules, because the rules have to be changed.” Greta went on to plan a multitude of student protests centered on action against our changing climate. Climate change is our reality, and youth activists like Greta are doing everything within their power to work against it, and demand a change.

González, a graduate of Marjory Stoneman Douglas High School, is a March for Our Lives co-founder.

The City of Thornton files lawsuit over Larimer County’s denial of 1041 permit

Thornton has filed a lawsuit against Larimer County commissioners in protest of their rejection of the Thornton pipeline, kicking off a legal battle on the Poudre River.

The city is asking the Larimer County District Court to overturn the commissioners’ decision and either approve one of the two proposed pipeline routes or force the county to do so.

Thornton’s complaint, filed in the Larimer County District Court on Tuesday night, argues the Board of Commissioners’ decision “exceeds its jurisdiction and/or is contrary to law, misinterprets and misapplies its criteria, and was arbitrary and capricious because its findings lack competent evidence to support the Board’s denial of Thornton’s application.”

In a statement, city spokesman Todd Barnes said Thornton “has taken action to represent the interests and property rights of their constituents.”

Thornton’s water plans wouldn’t diminish flows in the Poudre River because the project’s water is already diverted from the river for agriculture. But the “Poudre River alternative,” which would involve running Thornton’s water down the river and nixing the northern segment of the pipeline, picked up considerable public support during a series of hearings on the project.

“In discussion of Thornton’s proposal during the hearings, it is clear that the Board, contrary to its authority, factored into its decision the notion that Thornton should not build a pipeline but rather send its water down the Cache la Poudre River or down the Larimer County canal,” Thornton wrote in its complaint.

On the same day President Trump signed the Drought Contingency Plan into law, Imperial Irrigation District filed a petition in Los Angeles Superior Court alleging violations of the California Environmental Quality Act by the Metropolitan Water District of Southern California.

The petition calls on the court to suspend approvals and actions related to the Lower Basin Drought Contingency Plan until such time that an appropriate CEQA analysis and process has been completed.

“The logic in going forward without IID was that the DCP couldn’t wait for the Salton Sea,” said Henry Martinez, IID general manager. “This legal challenge is going to put that logic to the test and the focus will now be where it should have been all along – at the Salton Sea.”

IID’s petition alleges that MWD violated CEQA principles by committing to enter into agreements, on behalf of itself and all other California contractors, which will require MWD to forgo diverting up to hundreds of thousands of acre-feet of water annually from the Colorado River without considering how it will make up the shortfall.

“Metropolitan engaged in a prejudicial abuse of discretion and failed to proceed in the manner required by law,” wrongly determining that the DCP approvals were exempt from environmental laws, the suit continues.

CEQA is a statute that requires state and local agencies to identify the significant environmental impacts of their actions and to avoid or mitigate those impacts, if feasible.

Without IID’s participation, the Bureau of Reclamation and state water officials, including California, signed the DCP on March 19.

While IID worked to be a partner in the DCP process, the district objected, citing environmental issues posed at the Salton Sea and lack of federal funding commitments for the state’s 10-year Salton Sea Management Plan.

The district maintains that the Salton Sea is an integral part of the Colorado River system and its decline presents a severe public health and environmental crisis for the Imperial and Coachella valleys and the state.

IID has pointed out that MWD’s obligation to the river, under this DCP, could be over 2 million acre-feet.

“As long as IID was part of the DCP, the Salton Sea would have been insulated from impacts because IID could have protected it,” said IID board president Erik Ortega. “But under this DCP, particularly now that MWD is calling the shots for California and acting on behalf of the rest of the Colorado River, the Salton Sea is truly on its own. That’s why IID is acting to preserve its rights – and the Salton Sea’s future – by filing this CEQA challenge.”

The Shoshone hydropower plant on the Colorado River east of Glenwood Springs was not producing power for most of last week [April 7, 2019], but regional water managers went with the flow and — thanks to an “outage protocol” — honored the plant’s senior water rights anyway.

Plant operators with Xcel Energy notified state, federal and regional water managers April 5 that they needed to inspect a leak in a diversion tunnel adit, or access point. To do so, they would be slowly shutting the flow of water to the plant’s two 7.5 mega-watt (MW) turbines and taking the plant offline.

The facility’s two-mile-long tunnel runs through cliffs in Glenwood Canyon and moves water from behind a dam on the river to the penstocks above the plant, which is just upstream of the boat ramp for the Shoshone run. The plant, which Xcel began powering down April 5, was offline by April 8.

The plant stayed offline until Friday, when the leak in the tunnel was fixed and the plant began powering back up, according to Michelle Aguayo, a media-relations representative at Xcel.

The outage at what Xcel calls the Shoshone Generating Station did not affect local or regional power customers, because other electricity on the grid system made up for the loss of the plant’s capacity, Aguayo said.

In response to the plant going offline, officials at the state division engineer’s office lifted the call on the river on April 8. If the hydro plant is not in operation, the water right tied to it is not being put to beneficial use and cannot be administered, or legally enforced.

The call for water that is tied to the Shoshone plant’s most senior water right from 1902 means junior upstream diverters have to forego storing or diverting enough water to keep 1,250 cubic feet per second of water available for the plant.

Without the call, and the outage protocol, more water could be diverted under the Continental Divide or kept in upstream reservoirs, and less would flow through Glenwood Springs.

The outage protocol concept was prompted by the increase in outages at the Shoshone plant starting in 2004. It took on greater importance when a penstock at the plant ruptured in 2007.

The protocol was given a trial run in 2010, formalized in 2012 as part of the Colorado River Cooperative Agreement, and then signed as a stand-alone agreement in 2016.

Parties to the protocol include the Colorado River Water Conservation District, the Bureau of Reclamation, Denver Water, Northern Water, Aurora and other entities.

Protocol days

Number of days the Shoshone outage protocol, or ShOP, was in effect, and stages of the agreement.

According to Don Meyer — who is a senior water-resources engineer at the Colorado River District, which is based in Glenwood Springs — the protocol was in effect from April 8 until the call came back on the river on Sunday.

And he said it worked as intended, with the parties cooperating in an amiable manner.

“Without the outage protocol, the river probably would have been impacted,” Meyer said.

He also didn’t think most upstream operators changed how they were managing their water, because the protocol meant they were still working against a need to keep flows on the river at 1,250 cfs, even with the plant offline.

Fortuitous flows

The river rose, on its own, during the time the plant was out. But the outage protocol also helped boost flows.

The river’s level was also helped by a short warm spell that caused flows at the Dotsero gage, where the flow to Shoshone is measured, to rise above 1,250 cfs starting the day that the plant first started powering down on April 8.

By April 10, the river had risen to 1,750 cfs. But then cold weather dropped the river back under 1,250 cfs on Sunday, as forecast, just when the plant was powering back up and the call was coming back on.

If the plant had been down longer, and flows had stayed low due to cool mountain weather, the outage protocol could have mattered more to the flows in the river.

Meyer said that when the plant was offline for repairs in 2012, the outage protocol kept the river through Glenwood from falling below 1,000 cfs for about two weeks in late June of that notably dry year.

#Colorado files comments on proposed waters of the U.S. rule #WOTUS

The State of Colorado filed comments with the U.S. Environmental Protection Agency today expressing concerns about the proposed rule concerning waters of the United States (WOTUS). This proposed rule would remove protections for a number of Colorado streams and wetlands.

“Colorado places the highest priority on the protection of the State’s land, air, and water, and relies on a combination of federal and state regulations to ensure that protection,” the comments read. “The headwaters of Colorado provide a water supply to 19 states and Mexico, providing millions of people with water for drinking, agriculture, industries, and recreation and are critical to the survival of numerous species of concern.”

“If enacted, the Proposed Rule will remove huge swaths of Colorado’s waters from federal jurisdiction. In doing so, the Proposed Rule will impose significant burdens upon the State of Colorado’s government,” the comments explained.

These comments are the result of a collaborative effort by a number of state agencies and the lawyers in the Attorney General’s Office who represent them. “In Colorado, we work together to develop innovative solutions and address our challenges, such as protecting our land, air, and water. Exemplifying the Colorado way, our comments do not simply reflect what we believe needs to be changed in the proposed rule, we propose solutions that reflect the range of concerns related to how we protect water quality, providing a roadmap for the federal government,” said Governor Jared Polis.

“I am proud of how a range of agencies and the lawyers who represent them worked together so effectively on a complex issue. At this time in our history, we need to demonstrate leadership based on listening to a range of concerns and developing thoughtful solutions. Thanks to everyone involved for working hard to do just that,” said Attorney General Phil Weiser. “As this process goes forward, we will continue to operate in this manner.”

Today, President Trump signed a law authorizing a Drought Contingency Plan (DCP) to protect the Colorado River, following the bill’s passage through Congress with bipartisan support. The law, which follows years of negotiations and effort among the seven Colorado River basin states, will allow for voluntary, proactive conservation measures to take effect and bolster water levels in Lake Mead.

In response to the news, leading national conservation and sportsmen organizations issued the following statements:

“This is a historic moment for the Colorado River, the West, and the entire country,” said Kevin Moran, Senior Director for the Colorado River Program at Environmental Defense Fund. “Passing the DCP sets in place a foundation for conservation that will ensure a more secure future for the American Southwest. Now comes the hard work of implementing the DCP in each state. Today, [the President] took a historic step to reduce risk on the Colorado River by signing bipartisan legislation authorizing the Department of the Interior to implement Drought Contingency Plans in the Upper and Lower Basins of the Colorado River. This action supports agriculture and protects the water supplies for 40 million people.

The Colorado River is the single most important water resource in the southwestern United States and northwestern Mexico. All levels of government stepped up to address the Basin’s worst drought in recorded history. We’ve seen collaborative efforts among the seven Basin states, local water agencies, Tribes, Mexico and the Department of the Interior. Congress took prompt action on implementing legislation for the Drought Contingency Plans, and the President acted swiftly to sign that legislation into law. Adopting consensus-based DCPs is the best path toward safeguarding this critical water supply.

The president’s signing capped a years-long process of sometimes difficult negotiations among the seven states that rely on the river. Trump announced his approval of the bill in a tweet, calling it a “big deal” for Arizona…

…[the] signing comes just over a week after Congress fast-tracked bills through the U.S. House of Representatives and the Senate. Rep. Raul Grijalva, D-Ariz., and Sen. Martha McSally, R-Ariz., led those efforts and introduced identical bills endorsing the plan.

While Trump congratulated McSally, it was Grijalva’s version the president signed. That wasn’t a problem for McSally, who had said previously she supported the fastest path to approve the bill…

The one-page measure [the President] signed was not the drought plan itself, but legislation that allows the Bureau of Reclamation to carry out the plan. Next, representatives from Arizona and the other Colorado River basin states who had a hand in crafting the deal are expected to meet for a formal signing ceremony. The details haven’t been announced yet.

The plan they will sign aims to spread the effects of expected cutbacks to the river and protect the levels of the Colorado’s two largest reservoirs, Lake Mead and Lake Powell…

Brenda Burman, the reclamation commissioner, kept state water leaders and lawmakers in check with several strict deadlines, some of which were not met. Despite the pace, Burman said Tuesday in a statement that Trump’s action and the signing of such a landmark water deal was a historic step for the Southwest’s water future…

This aims to protect water users from losses and prevent Lake Mead and Lake Powell from falling to critical lows. Lake Powell is 37 percent full, while Lake Mead is 41 percent full, just above a threshold that would trigger a first-ever declaration of a shortage by the federal government.

The three-state lower basin agreement, negotiated among California, Arizona and Nevada, lays out a framework for taking less water from Lake Mead and sharing in cutbacks between 2020 and 2026.

A new study released by the U.S. Bureau of Reclamation predicts a release of up to 9 million acre-feet of water from Lake Powell to Lake Mead this year, which means a possible shortage declaration looming in 2020 might be averted.

The snowpack in the Colorado River Basin is about 130 percent of average, with flows into Lake Powell predicted to be 128 percent of average during the runoff season.

According to the bureau’s 24 month operational study, the projected release will be updated each month and reflect the fluctuating levels at Lake Mead. Lake Mead’s Jan. 1, 2020, elevation is forecast to be 1,084.27 feet, almost 10 feet above the shortage determination trigger of 1,075 feet…

The seven basin states recently approved drought contingency plans, endorsed by Congress and awaiting the signature of President Donald Trump.

Should Lake Mead drop below the 1,075 elevation, that would trigger shortages for Arizona and California.

The contingency plans are designed to provide a workaround among all the states to reduce consumption and still ensure adequate delivery of water to the lower basin…

In fact, a 2012 benchmark study by the bureau showed that in the previous 10 years, the upper basin delivered more than 92 million acre-feet of water to the lower basin states of Nevada, Arizona and California — or 17 million acre-feet more than what was required under the compact.

“Today, with the signing of this bill, it is our hope that the oil and gas wars that have enveloped our state are over, and the winner is all of us,” said Polis, a Democrat.

The state has struggled for years to balance the interests of the booming industry against growing concerns of people who live nearby drilling rigs, wells and tanks.

Colorado ranks fifth nationally in crude oil production and sixth in natural gas. The industry says it contributes $32 billion annually to the state economy, including taxes and 89,000 direct and indirect jobs.

But fast-growing communities north of Denver are spilling into the state’s most productive oil and gas area, the Wattenberg field, sparking complaints about noise and pollution and provoking fears about explosions…

Supporters said the law brings much needed protections for Colorado’s booming population, its environment and its growing recreation industry.

Opponents warned the law could stifle a major industry, kill jobs and shrink tax revenue.

    A new study shows that mysterious cycles in salinity in the lower Colorado River are a result of precipitation patterns in the headwaters of the upper basin more than a thousand river miles away. The salinity levels generally repeat about every 10 years.

    Beginning in the late 1970s, these decadal-scale salinity cycles were observed at monitoring locations on the lower Colorado River in the U.S., hampering the Bureau of Reclamation’s efforts to manage salinity in the river for delivery of water to Mexico to meet obligations under an international treaty.

    The Colorado River provides water for more than 35 million people in the U.S. and 3 million in Mexico. The river also sustains agricultural production of food for millions in both countries. Mexico uses nearly all of its Colorado River allotment for irrigation. High salinity in irrigation water can reduce agricultural productivity and may preclude growing crops such as tomatoes and lettuce.

    The new findings published in the Journal of Environmental Management were conducted by the USGS in cooperation with the Bureau of Reclamation.

    “It’s important for Reclamation to be able to understand and forecast changes in salinity in the lower Colorado River as management actions may be required,” said Fred Tillman, lead author of the study. “Understanding the causes of the salinity cycles will provide Reclamation with about 4 years of advance notice on future changing salinity cycles in the lower river.”

    USGS scientists tracked salinity cycles from the northern international boundary with Mexico, upstream through Lake Mead and the Grand Canyon, to Lees Ferry using extensive streamflow and water- chemistry datasets. Scientists first hypothesized that evaporation in Lake Powell may cause the cycles. However, evaluation of lake water levels, evaporation data and salinity results from Lake Powell eliminated the reservoir as the cause. Scientists continued their search even farther up the basin, finding that monitoring data from the Green, Colorado and San Juan Rivers in the upper basin all showed salinity cycles that were similar to those seen on the lower river. Cyclical patterns in precipitation in the upper basin were discovered to be causing the cyclical salinity patterns in the river that then travel downstream relatively unchanged.

    Startling climate change conclusions of Colorado researcher

    A startling fact has emerged from what the New York Times Magazine describes as a basement full of dusty reports in the mountains of Colorado.

    There, climate data researcher Rich Heede has concluded that if you include all the carbon extracted and supplied, just 90 companies are responsible for two-thirds of all the greenhouse gases emitted between 1751 and 2016.

    “Even more startling,” the story goes on to say, “more than half those emissions have occurred since 1988, the year that the climate scientist James Hansen, then at NASA, appeared before Congress to urge that ‘it is time to stop waffling’ and recognize the clear link between the emission of greenhouse gases and the warming of the planet.”

    Heede, who has a non-profit called Climate Accountability Institute, seems to work from a home overlooking Capitol Creek. This is a valley away from Snowmass, perhaps 25 minutes from Aspen. Nearby, in the early 1980s, Amory Lovins and his then-wife, Hunter Lovins, founded his now-famous Rocky Mountain Institute. Heede shows up at some of the same energy and climate conferences I attend. I’ve engaged him in conversation a time or two, even got him to buy a small advertisement in Mountain Town News.

    The Times explains that Heede has spent much of the last 16 years searching through archives to find reports about how much fossil-fuel companies extracted during their sometimes long histories. He then “estimates how much fossil fuel was used for a company’s own operations, how much diverted for things like asphalt or petrochemical production, how much volatilized into the atmosphere.” It is, says the NY Times Magazine writer, Brooke Jarvis, tedious work.

    But Heede’s work is also perhaps pivotal to a growing body of lawsuits being filed around the world against fossil fuel companies. They include a lawsuit filed last year by Colorado’s San Miguel County and two other local jurisdictions, the municipality of Boulder and Boulder County, linking the profits of Suncor and ExxonMobil with emerging impacts of increased wildfire, extreme weather, and so forth.

    That lawsuit on the face of it looks almost frivolous. How can you connect these dots of specific causality when even now the impacts to climate of rising temperatures have barely emerged from the noisy range of natural variability?

    The NY Times Magazine piece makes the same point: “The sheer vastness of the climate problem has been a boon to defendants.” One lawyer who has spent his career defending large companies in environmental litigation says he would broaden the case as much as possible. “I would basically create a historical tableau and put civilization on trial.”

    Just last year, a federal judge dismissed the claims filed by Oakland and San Francisco against five oil companies. “The dangers raised in the complaints are very real,” Judge William Alsup wrote. “But those dangers are worldwide. Their causes are worldwide. The benefits of fossil fuels are worldwide. The problem deserves a solution on a more vast scale than can be supplied by a district judge or jury in a public-nuisance case.”

    But for plaintiffs in the new wave of cases—including, presumably, those involving the Colorado jurisdictions—such defenses “represent a fundamental misunderstanding not only of what the lawsuits are claiming but also of what the law is capable of handling.”

    Jarvis starts her story in a Peruvian village threatened by disintegrating glaciers. The loss of ice threatens the village in several ways, including the possibility of a calving glacier plunging into a lake above the town, causing flooding. She’s apparently bilingual and it served her well when she was doing her reporting there, connecting well with a villager—a farmer and guide—who is the face for a lawsuit filed against a German fossil fuel company. The lawsuit was not dismissed easily, as in the Oakland and San Francisco cases, but has moved to the evidentiary phrase.

    If the Colorado lawsuit gets that far, it will still face a long list of difficult questions, among them those posed by Jarvis in her story:

    “Where on the chain of causality—from coal extraction to power generation, for example— does responsibility lie? How do we put a dollar amount on the degree of liability? How do we account for non-climate variables, such as whether a city magnified its exposure to damages from wildfire or rising seas by permitting development in risky places? How should other contributors to climate change, from deforestation to population growth, be considered?”

    But at one time lawsuits against tobacco companies looked like long-shots, too. She reports that proponents of lawsuits against fossil-fuel companies have studied the earlier lawsuits carefully. “The tide began to turn against the tobacco industry once subpoenaed documents showed a longstanding conspiracy to cover up the harms of smoking,” she says.

    In the case of fossil fuels, what might this look like? After all, we do have evidence of Exxon realizing the risks of fossil fuels decades ago. “Some observers imagine a future in which fossil-fuel companies support carbon regulation because it includes a provision shielding them from a morass of liability.” There are other ideas where all this may go.

    Flowing out of the nation’s first wilderness area, the Gila River supports outstanding examples of southwestern riparian forest, cold-water fisheries and a remarkable abundance of wildlife. The Gila River provides significant economic value to the region, with superb opportunities for outdoor recreation, nature-based specialty travel and wilderness experiences. It is also important to indigenous peoples who have lived in southwestern New Mexico for thousands of years. Many cultural sites are found along the Gila River and throughout its watershed. Furthermore, the Hispanic community has a culture, heritage and way of life tied to the river and forest, where generations continue to hunt, fish, hike and enjoy family time together.

    After more than a decade of planning and more than $15 million spent, a substantial diversion project is in the last year of review under the National Environmental Policy Act. A draft environmental impact statement is expected in April 2019 with a record of decision by the end of 2019. Despite the projected high costs, severe delays in schedule and feasibility issues with multiple iterations of the diversion proposal, this project continues to move forward with likely support from the Trump administration.

    In this critical year, New Mexico Governor Michelle Lujan Grisham can eliminate the threat to the Gila River by withdrawing the project from the Arizona Water Settlements Act process and instead spend available AWSA funding on non-diversion projects to meet the water needs of communities throughout southwest New Mexico. Governor Lujan Grisham has pledged to end work on the diversion by using these funds more efficiently on other projects and to ensure that the Gila River is protected by federal law. We urge her to fulfill this promise, saving taxpayers and water users money, providing direct benefits for area farmers and businesses and protecting the Gila River for future generations.

    Last week, when Gov. Michelle Lujan Grisham signed the last of the bills from the 2019 legislative session, she line-item vetoed $1.698 million in New Mexico Unit funding for the Gila River diversion.

    Tripp Stelnicki, the governor’s director of communications, said Lujan Grisham has been clear about her views on the diversion project. He added that the administration’s opposition to it “does not come down to one veto or one source of funds but rather the policies that will be spearheaded by the OSE and ISC.” The Office of the State Engineer and the Interstate Stream Commission are the state’s two water agencies.

    Since January 2012, the U.S. Bureau of Reclamation has deposited more than $60 million into New Mexico’s coffers for the project. Already, about $15 million of that money has already been spent (plus about another $2 million in state money), even though plans for the project have yet to be solidified and no one has yet identified buyers for the water, which would cost about $450 per acre foot. (And those contracts would need to be approved by both the New Mexico Office of the State Engineer and the U.S. Department of the Interior.)

    After the New Mexico Interstate Stream Commission voted in 2014 to build the diversion, the state created the New Mexico Central Arizona Project. Made up of representatives of local irrigation districts, counties and towns, the entity oversees its construction, maintenance and operation. To receive the full federal subsidy for the project, the entity is supposed to have completed environmental studies and received approval from the secretary of the Interior Department by the end of 2019. But despite the millions of dollars spent, the project is about 18 months behind schedule.

    Saguache: Folks in the San Luis Valley express opposition to out of basin export plan

    Renewable Water Resources (RWR) managing partner Sean Tonner made his water export presentation to an overflow crowd at the Saguache Road and Bridge Building [April 9, 2019] evening, but nearly all those attending made it clear they were not receptive to the plan.

    Tonner opened the discussion by telling county residents the plan is “still in the formation stages and has years to go.” He said he has already held 150 meetings to explain the project.

    A former chief of staff for Gov. Bill Owen, who supported the plan, Tonner also worked with former State Senator Greg Brophy and other government officials on the project. Currently Tonner owns the 11,500-acre Gary Boyce ranch, purchased from Boyce’s wife following his death. He also leases grazing land in the same area.

    Tonner claims less than two percent of the annual confined aquifer recharge — 500,000 acre-feet — is needed by the Front Range. Farmers could sell all or a portion of their water rights to RWR for twice the going amount. A total of $60 million has been set aside to procure water rights.

    Already enough Saguache County farmers and ranchers have agreed to sell their water rights to satisfy the proposed 22,000 acre-feet project, Tonner reported. The plan is said to be able to retire more than 30,000 acre-feet, reducing the overall usage from the basin. This would presumably lessen the pressure on existing rivers and streams now providing water to the Front Range.

    A pipeline along Highway 285, restricted to a 22,000-acre-foot capacity, would carry the water up over Poncha Pass into Chaffee County and from there it would eventually make its way into the Platte River. There would be no adverse impact on wildlife, Tonner claims.

    The project would create a $50 million community fund for the county that could be used for a variety of purposes including education, law enforcement, tourism, economic development, conservation and other worthy cause. The county would manage the fund. Just the interest would generate $3-4 million annually which is twice the amount of the county’s sales tax grants, he pointed out.

    Commissioners question Tonner

    Citizens were asked to listen only during the meeting, although there was one uninvited comment by longtime water consultant Chris Canaly. Commissioners then offered their responses to Tonner’s plan, beginning with Jason Anderson.

    Anderson asked Tonner if he had researched the plan to see if any communities in either Colorado or nationwide had ever benefited from water exportation. Tonner could not answer the question, although he told Anderson he is familiar with the history of similar projects.

    J. Anderson also challenged Tonner’s statement that there is one to two billion acre-feet of water in the aquifer beneath the Valley, some of it below sea level. “We have a guess about what’s down there, but no one really knows,” Anderson told Tonner, echoing the opinions of several water exports who have advised the county. “And they estimate that all this water is connected, so where are the benefits, say, for Alamosa and Costilla counties?”

    RWR replied that the benefit would lie in a lessening of the burden of water replacement. Commissioner Ken Anderson challenged Tonner on his definition of Front Range, reminding him that the San Juans are the higher front range. K. Anderson said he also had questions about the model RWR is using.

    Commissioner Jason Anderson then asked Tonner what the county would do about the promised money for the community fund if there is another recession. RWR replied there would likely be another economic downturn, but said he thought it “is pretty bad when we have the ability to solve problems with renewable resources we are not going to use” and fail to do so.

    This brought a united protest from the crowd, who denied the county’s water resources are “renewable.” Anderson reminded attendees that Tonner had a right as a Saguache County resident to voice his opinion whether they agreed with his ideas or not.

    Pagosa Springs: Meeting to discuss new San Juan cutthroat trout management, April 16, 2019

    Management plans for a new pure genetic strain of cutthroat trout will be discussed at a meeting, 6:30 p.m., April 16 at the Springs Resort, 165 Hot Springs Blvd. in Pagosa Springs.

    The meeting will be led by representatives from Colorado Parks and Wildlife, Trout Unlimited-Five Rivers chapter and the U.S Forest Service.
    The unique San Juan River cutthroat trout was found by Colorado Parks and Wildlife biologists several years ago; however, the find was only verified last year thanks to advanced genetic testing techniques. Specimens of the fish were found in eight remote and isolated streams in Southwest Colorado on public and private land. Last summer, some trout were spawned on site and the fertilized eggs were taken to CPW’s Durango hatchery to be raised. Some trout were also removed because the streams were in danger of being damaged by the 416 Fire.

    “The goal of the meeting is to provide additional information on the San Juan Cutthroat trout lineage discovery, how we plan on conserving the fish, and what that might mean for fishing opportunities in the future,” said Jim White, CPW’s aquatic biologist in Durango.

    The focus of the initial conservation efforts will be in the upper reaches of Wolf Creek in Mineral County. A portion of the creek was treated last summer to kill non-native trout in the stream. CPW hopes that some San Juan cutthroats can be stocked there this summer. CPW is also working with the U.S. Forest Service, Trout Unlimited, water agencies and private landowners to identify other waters where the fish can be stocked.

    Discovery of the fish dates back to 1874 when naturalist Charles E. Aiken removed and preserved two of the fish and placed them in the Smithsonian Natural History Museum in Washington, D.C. The specimen was forgotten until 2012 when researchers from the University of Colorado and CPW were searching for old trout specimens in the nation’s museums. When the researchers tested tissue from those two specimens they found genetic markers unique to the San Juan River Basin. Armed with the knowledge of these genetic “fingerprints”, CPW researchers and biologists set out to test all the cutthroat trout they could find in the basin in search of any relic populations.

    John Alves, senior aquatic biologist for CPW’s Southwest Region in Durango, said re-establishing the fish will be a long-term process.
    “Finding and identifying the fish was a tremendous discovery,” Alves said. “But because the populations we’ve found are so small it will take years of work by CPW’s fish culturists and our biologists to establish self-sustaining populations.”

    Cutthroat trout originated in the Pacific Ocean and are one of the most diverse fish species in North America with 14 different subspecies. Three related subspecies are found in Colorado: Colorado River cutthroat trout found west of the Continental Divide; greenback cutthroat trout in the South Platte River Basin; and the Rio Grande cutthroat trout in the San Luis Valley. Cutthroats from each of these areas have specific and distinctive genetic markers. CPW propagates the three remaining subspecies, and actively manages their conservation and recovery throughout the state.

    On Monday, 30 officials and residents attended an informational meeting at the Dolores Fire Station hosted by Montezuma County emergency manager Mike Pasquin.

    The town has not experienced a major flood from the river since 1911, which filled the town valley with up to 3 feet of water.

    But there is potential this year because of the heavy snowpack, warming weather, and wet El Niño weather pattern.

    The Dolores River peaks from snowmelt between May 15 and June 15, officials said. How much comes down and at what rate depends on snowpack levels, temperature, rain and soil moisture. Runoff forecasting is an educated guess, and possible flood levels require ground truthing as well.

    There are some trigger points to watch for, officials said.

    Flood stage for the Dolores River in town is 8 feet. A safe maximum flow of the Dolores River is about 6,000 cubic feet per second in town, said Ken Curtis of the Dolores Water Conservancy District.

    Flows above that increases the risk of flooding, and flows of 7,000 or 8,000 cfs would start to overflow the banks. Flows can be viewed by visiting the Dolores River Boating Advocates web page

    Increased flows from a hot spell or rain event in the upper valley takes time to reach town and usually arrives at night, said town board member Val Truelsen, “so there should be some nighttime monitoring of the banks.”

    Residents should stay tuned to the National Weather Service for regional and local flood watches and warnings.

    Montezuma County Sheriff Steve Nowlin said the community will be given warnings about predicted flooding conditions through media outlets, town reports, reverse 911, Nixle and social media. The town has recently repaired emergency siren that would also be activated as a warning.

    Bridges up the valley are being monitored for debris accumulation and to ensure boaters can safely get under them. Collapsed mines in Rico that collect runoff have automated sensors that warn emergency personnel if the pressure and levels are too high, triggering relief valves.

    Community sandbagging projects are happening in some flood-prone towns in the state, said Karen Dixon, emergency manager for the county health department. Local agencies said they are ready to respond to a flood emergency with equipment and staff.

    If needed, sand is available at the county shop on County Road 30, said county road manager Rob Englehart.

    Officials said severe flooding could compromise utility systems such as water, sewer and natural gas lines, and cause them to be shut down until the water recedes and repairs are made.

    Potential shelter areas for evacuees discussed were the Dolores Community Center, Dolores High School, county fairgrounds, House Creek and McPhee campgrounds, and Canyons of the Ancients Museum and Visitor’s Center.

    A monthly study released today by the Bureau of Reclamation indicates this winter’s plentiful snowpack will benefit the Colorado River Basin through increased runoff to crucial reservoirs. With the improved hydrology, Lake Powell’s operation for water year 2019 will shift to a balancing release of up to 9.0 million acre-feet. Snowpack in the upper Colorado River basin is about 130 percent of average, with a forecasted April through July inflow into Lake Powell of 9.20 maf, or 128 percent of average. That above-average inflow projection is due to extremely wet conditions in the basin during February and March. Releases from Lake Powell to Lake Mead are consistent with the 2007 Colorado River Interim Guidelines for Lower Basin Shortages and the Coordinated Operations for Lake Powell and Lake Mead.

    “This year’s snowpack is welcome news for the Colorado River Basin,” said Reclamation Commissioner Brenda Burman. “But one good year cannot reverse the effects of nearly two decades of severe drought. Current total Colorado River System storage is approximately 45% of full capacity.”

    Commissioner Burman continued, “Recent accomplishments like the drought contingency plans provide an important bridge to minimize risks from ongoing drought and gain valuable operating experience during the remaining period of the 2007 operating guidelines.”

    The April 2019 24-Month Study projects Lake Mead’s January 1, 2020 elevation to be 1,084.27 feet, almost 10 feet above the shortage determination trigger of 1,075 feet. The August 2019 24-Month Study projections will be used to determine the operating tiers for Lake Powell and Lake Mead in 2020.

    Forecasters say northern Colorado will warm up slowly after this week’s snowstorm, minimizing the danger of flooding this week. National Weather Service hydrologist Triste Huse said Thursday that daytime temperatures will reach only into the 40s for the next few days and dip below freezing at night.

    Huse says deep winter snows in the Colorado mountains could worsen the flood danger in May, however.

    The water content in the mountain snow on [April 11, 2019] ranged from more than 110 percent of normal in the northern part of the state to more than 150 percent in the southwest.

    In Colorado rafting country, anticipation is building with the water.

    “It’s going to be a great season, no doubt about that,” says Brandon Slate, president of the Arkansas River Outfitters Association, whose members at this time last year faced a much different outlook.

    With parched mountains amid drought, 2018’s preseason story lines focused on the Upper Arkansas Voluntary Flow Management Program. Regulators delivered by releasing enough from reservoirs to keep boats afloat through the summer — “a lifesaver,” says Salida-based Bill Dvorak, with 40-plus years in the rafting business…

    At the start of April, river rats were eyeing charts that showed the state’s snowpack well above 100 percent of normal — a bounty set to melt and swell rivers to epic proportions.

    Longtime outfitters are thinking back to 1995, the last time the forecast looked this promising. That year, Dvorak recalls the Arkansas raging 6,700 cubic feet per second (700 is “optimal” under the voluntary flow management program).

    “It’ll get up to 4,000 I’m sure this year,” he says. “Maybe up to 5,000, 6,000.”

    But what excites Dvorak most is the potential of a lesser-known river outside his home territory…

    In circles like his, the Dolores is regarded as legendary. Stretching through remote forests, canyons and deserts in the state’s southwest corner, it stacks up with America’s best, Dvorak says, the Grand Canyon and Middle Fork of the Salmon among them.

    But whitewater buffs’ chances on the stretch have been few and far between. Since the late ‘80s, the McPhee Dam has trapped the water that once kept the Dolores running strong…

    Utah’s Cataract Canyon is expected to reclaim its Class 4 and Class 5 reputation. The Yampa River through Dinosaur National Monument’s storied land should be back to consistently raftable levels.

    The Rio Grande was running fast and wide around a bend near the Buckman Direct Diversion near Diablo Canyon one recent April day — a healthy sign that the snowpacked mountains of southern Colorado and Northern New Mexico are already providing a welcome, healthy spring runoff…

    Water experts and conservationists agree. Following a particularly dry 2017-18 winter season, the spring 2019 runoff into the region’s rivers, streams and arroyos is looking downright wonderful, offering at least a brief respite from continuing drought conditions…

    The 216 million-gallon Nichols Reservoir is full, said Alan Hook, a water analyst for the city. The larger McClure Reservoir — with a capacity of 1.06 billion gallons — is 61 percent full, with about 648 million gallons of water in it, he said.

    The runoff also will help recharge city wells, Hook said.

    Farmers and ranchers around the state stand to benefit as well. Elephant Butte Irrigation District officials said last week that farmers can expect to get their share of irrigation water as soon as early June, with an allotment of 6 inches per acre. That allocation could increase, depending on how much snowmelt ends up in the Rio Grande.

    From a recreational standpoint, more water in the state’s rivers, streams and reservoirs could lead to more fishing, boating and rafting throughout the spring and summer…

    Still, she said, the actual flows into New Mexico are uncertain. Under the 1938 Rio Grande Compact, Colorado is required to deliver a certain amount downriver every year, but that volume is largely dependent on how much water southern Colorado farmers use to irrigate their fields…

    While much of the flows into the Rio Grande come from headwaters in the San Juan Mountains, Steve Harris, executive director of Taos-based Rio Grande Restoration, said about a quarter of the water comes from runoff from Northern New Mexico mountains.

    The U.S. Natural Resources Conservation Service issued a report April 1 that said with year-to-date precipitation totals “coming in with impressive triple digit numbers as high as 139 percent, the spring runoffs are looking favorable” in New Mexico.

    The report also said major reservoirs in the state are “storing well below average amounts of water. … They have been depleted and await runoff this spring for a recharge.”

    For the first time since January 2018, New Mexico has no areas considered to be in extreme or exceptional drought, according to the U.S. Drought Monitor.

    According to SNOTEL readings as of mid-February, Colorado’s statewide snowpack sat at 108 percent of normal and the Rio Grande Basin also was above the norm…

    Snowpack is higher in the northern and eastern basins and lower in the southwestern basins.

    Climate forecasts through the runoff season suggest that these numbers could climb higher as forecasts indicate a wet spring statewide.

    New Reservoirs, Dams Planned for Colorado Front Range — Engineering News Record

    “In the water-scarce West, there is little to no new water,” says Laura Belanger, water resources and environmental engineer with Western Resource Advocates. “What we’re seeing is a shift to a suite of solutions that make the most of our region’s water resources. So the first line is and always should be conservation, because that’s the most cost-effective thing utilities can do, and it’s also fast.”

    In Colorado’s Front Range, the Northern Colorado Water Conservancy District is accepting qualification statements for construction of Colorado’s tallest new dam in a half-century, with selection of a contractor and notice to proceed by December, says Joe Donnelly, spokesman. The main dam will be a rockfill structure with a hydraulic asphalt core, 360 ft tall and 3,500 ft long at the crest. The dam will impound the 90,000 acre-ft Chimney Hollow Reservoir for the Windy Gap Firming Project. A contract for design was awarded to Stantec in 2016.

    The reservoir would store water for 12 municipalities and other water suppliers. The project has support from both public authorities and some environmental advocates. But six environmental groups are contesting the project in federal court because it will divert 30,000 acre-ft annually from the Colorado River, taxing the already challenged flow of that body.

    Denver Water is proceeding with the expansion of Gross Reservoir, built in the 1950s with a 1,050-ft-long, 340-ft-tall concrete gravity arch dam impounding 42,000 acre-ft of water. Following 14 years of planning, the U.S. Army Corps of Engineers issued a 404 permit in July 2017, allowing Denver Water to raise the reservoir’s dam 131 ft and expand the reservoir’s capacity to 77,000 acre-ft.

    The utility is expanding the reservoir to address a known imbalance in the city’s water system, said Jeff Martin, program manager for the project, in a video on the project’s website. The North System, where Gross Reservoir is located, stores about 30% of the water, and the South System the rest. The imbalance results from differential snowpack runoff on the system’s north and south sides. “This will provide extra insurance and extra reservoir capacity to make sure that we can weather those times when we do have issues in our system,” Martin said…

    Some existing storage facilities are being expanded or are having their water reallocated, and regional water sharing also is beginning to grow, Belanger says. She cites the Chatfield Reservoir, built in 1965 on the South Platte River south of Denver for flood control, as an example. The U.S. Army Corps of Engineers determined that up to 20,600 acre-ft of the water can be reallocated to drinking water and industrial supply, agriculture, environmental restoration and other purposes without compromising its flood-control function. Environmental mitigation and modifications are expected to cost about $134 million.

    This week, Congress passed a bill directing the Secretary of the U.S. Department of the Interior to implement an agreement worked out by states that rely on water from the Colorado River. The Colorado River Drought Contingency Plan Authorization Act easily passed both chambers and now awaits a signature from the president.

    The plan acknowledges that flows of the Colorado River—which supplies drinking water to 40 million people and irrigates 5.5 million acres—are declining. And it represents efforts by the states, cities, water districts, tribes and farmers to make changes that will keep two important reservoirs from dropping too low. Had they not come to an agreement, the U.S. Bureau of Reclamation would have imposed restrictions on water use.

    Once the bill is signed, and the Drought Contingency Plan enacted, U.S. Sen. Tom Udall said it will have long-term benefits for water users in New Mexico, including tribes and farmers, cities like Santa Fe and Albuquerque and ecosystems and wildlife…

    Over the past years, the [Upper and Lower] basins worked on developing their own drought plans and then came together in a final agreement aimed at ensuring people still receive water, even as flows decline, and making sure Glen Canyon Dam can still generate hydropower and deliver electricity. It’s also meant to make sure water levels don’t drop too low in Lake Mead and Lake Powell…

    Combined storage in the two reservoirs last year reached its lowest level since Lake Powell began filling in the 1960s. As of April 10, Lake Powell’s level was at 3,569 feet, roughly 37 percent full.

    In 2017, a study showed that between 2000 and 2014, annual Colorado River flows averaged 19 percent below the 1906-1999 average. Models showed that warming will continue to drive declines in river flows—by between 20 percent to 30 percent by mid-century and 35 percent to 55 percent by 2100. More recently, authors from the University of California-Los Angeles and Colorado State University found that 53 percent of the decrease in runoff is attributable to warming; the rest to reduced snowfall within regions that feed into the system.

    This winter’s snowpack is anticipated to stave off an emergency.Current forecasts estimate Lake Powell will be at about 3,592 feet, with about 12.89 million acre feet of stored water (and 55 percent full), at the end of this water year.

    NM has learned lessons from drought

    Under the Colorado River Compact, New Mexico is allowed 11.25 percent of the Upper Basin’s annual allocation of 7.5 million acre feet.

    New Mexico’s share of the Colorado River water is relatively small. On average, New Mexico uses about 410,000 acre feet of water from the basin. Arizona and California, meanwhile, each use millions of acre feet annually.

    In New Mexico, cities like Aztec, Farmington and Bloomfield rely on water from the San Juan and its tributary, the Animas River, as do local ranchers and farmers. The San Juan supplies water to cities to Albuquerque and Santa Fe and the Middle Rio Grande Conservancy District via the San Juan-Chama Project. And during last year’s low flows on the Rio Grande, it was water from the San Juan-Chama Project that kept the Rio Grande flowing through Albuquerque. Both the Navajo Indian Irrigation Project and the Navajo-Gallup Water Supply Project, which is still being built, rely on water from the Colorado River Basin. The Jicarilla Apache Nation in northern New Mexico has rights to Colorado River water, as well.

    Rolf Schmidt Peterson, Colorado River Basin Manager for the New Mexico Interstate Stream Commission, explained that as opposed to the Lower Basin states—which are already using all the water they have rights to, and more—New Mexico and other Upper Basin states were in a better position to come up with their drought contingency plan.

    The Lower Basin will have to pull back on uses, whereas the Upper Basin can plan ahead on how to avoid water shortages.

    Warming temperatures but especially so during spring months

    In Pennsylvania, the groundhog known as Punxsutawney Phil saw no shadow this year. That is supposed to portend an early spring.

    In the Rocky Mountains, early springs have been coming no matter what. This was a cold winter in many places, but on average the climate has been warming for several decades. It’s sure to get much warmer yet.

    A case in point is Colorado’s North Park, headwaters of the North Platte River but a short distance from the headwaters of the Colorado River and also the Steamboat ski area.

    There, according to Dr. J.J. Shinker, an associate professor from the University of Wyoming, the temperature overall has increased 1.44 degrees Celsius (2.6 degrees Fahrenheit) since 1909.

    But warming during the spring months of March, April, and May has been disproportionate, rising almost 4 degrees Fahrenheit (2.21 degrees C) on average since 1909.

    “That’s a lot of warming in a short period of time,” she told members of the Colorado Water Congress at a recent conference. She also pointed out that warming at high elevations has been disproportionately greater than the global average.

    (But Jeff Lukas of Western Water Assessment, the lead author of “Climate Change in Colorado,” the 2014 synthesis report sponsored by the Colorado Water Conservation Board, points out that “there is no robust and consistent evidence that higher-elevation regions in Colorado are warming at a different rate than lower-elevation regions.”

    But of disproportionate warming during spring, there is no dissent. And that produces earlier runoff in the North Platte and other rivers in Colorado. On average, runoff occurs five days earlier for every degree Celsius in warming.

    This matters to water managers, who try to ensure the irrigation ditches still have enough water come August and September. It also matters to mountain resorts as warming springs shrink the backend of ski season.

    But everybody should be concerned for two more reasons, says Shinker. First, the worst droughts we’ve seen, the worst on record since Eurosettlement about 150 years ago, don’t come close in depth and intensity to those of the past. Forest fires of the past were also giant affairs.

    This was part of natural variability. But now there is the overlay of what might be called unnatural variability, this overlay caused by human forcing of the climate.

    “The warming that we are seeing is occurring at a rate that is outside the range of natural variability,” Shinker said in an interview after her talk to Colorado water managers. “And it’s occurring as a result of the greenhouse gases that result from human activity.”

    Paleoclimatologists can tell much about shifting climates of the past 12,000 years by studying high mountain lakes. Consider Emerald Lake, which is in Colorado’s Sawatch Range, near the trailheads to the state’s two highest mountains, Elbert and Massive. Scientists studying lake sediments and other clues have documented shorelines that a millennium ago were much lower. The droughts then lasted for decades, even hundreds of years, what are called megadroughts.

    Lake of the Woods, which is located in Wyoming along the Continental Divide south of Jackson Hole, also offers evidence deciphered by scientists of a megadrought 5,200 years ago.

    The point, said Shinker, is that natural variability has always occurred in the interior West. So, too have, extreme events, such as the wildfires that accompanied a megadrought in North Park about 2,000 years ago.

    In the Colorado River Basin, scientists have reached much the same conclusion. Undeniably, there have been several hard drought years since 2000. But Brad Udall of Colorado State University and other scientists have concluded that it’s not a drought as conventionally understood. Rather, rising temperatures have begun causing more evaporation and transpiration, resulting in less water getting downstream.

    That doesn’t mean conventional climatic forces don’t have swagger. From her post in Wyoming, Shinker studies what causes natural climatic variability in the interior West, such as movement of the polar jet stream north and south. But now there’s an overlay to those natural climatic variations, one created by human activities.

    Despite its designation as a desert, the Coachella Valley is blessed with water. The very names associated with the most prominent places and businesses in the desert, such as the Oasis Hotel, Mineral Springs Hotel, Deep Well, Indian Wells, Palm Springs, Snow Creek, and Tahquitz River Estates, all conjure up pretty images of water.

    But the early story of desert water is more utilitarian than picturesque: it quite literally can be seen as a history of ditches.

    More than a century ago a prescient and patient few understood that water was the most precious of all resources in such an arid region. Hydrology was the purview of engineers, and the first way to move water was in ditches. The most famous Southern California water scheme, made to ensure a reliable water supply for burgeoning Los Angeles, came at the cost of turning a once fertile pasture surrounding a lake situated 200 miles away from LA into a dust-polluting salt flat the size of San Francisco. But here in the natural desert, there were visionaries thinking about using local water and building their own infrastructure to deliver it.

    As early as 1830, the local Cahuilla people brought water from Tahquitz Creek to their village by simple ditches constructed for irrigation. The flow was seasonal and subject to diversion and clogging. Those at the end of the line seldom got water.

    In 1887, early white settler John Guthrie McCallum formed the Palm Valley Water Company and began the construction of a stone-lined irrigation ditch to traverse what is variously reported as 16, 17, or 19 miles of desert between the San Gorgonio Pass and Palm Springs to carry the flow of the Whitewater River (whatever the actual distance, it was an astonishing accomplishment).

    McCallum also developed the waters of Chino Canyon for irrigation, and hoped to prosper by raising figs, grapes, olives and apricots earlier than coastal farmers. There were unauthorized diversions of the sluice and many disputes — exacerbated by a flash flood that destroyed the canal — followed by more than a decade of drought during which most of any civilization in the Coachella Valley perished. By 1905, when the drought finally ended, actual lack of water and legal disputes over water rights left very few Cahuilla and even fewer white settlers in the region…

    In 1927, Alvah Hicks acquired the Palm Valley Water Company with a loan from Mr. O’Donnell, reorganized it and changed its name to the Palm Springs Water Company. Hicks sourced water from Snow Creek and Falls Creek, each with their own conduits, while presumably improving water pressure up the hill. Alvah’s sons Harold and Milton Hicks took over the stewardship of the company from their father, expanding pipelines and supplies. Alvah prided himself on building for future capacity and his sons carried on that forward-thinking practice. Therefore, in addition to the flumes, wells were drilled to tap into the aquifer — the vast lake beneath the valley floor. Ironically, abundant water had been just below the ground for millennia — a legacy of the prehistoric Lake Cahuilla that had once inundated much of the valley…

    [P.T] In 1927, Stevens formed the Whitewater Mutual Water Company and supplied irrigation water from the Whitewater River for residential and agricultural use. He had his own system of pipes and ditches that would divert the river, while allowing for intermittent flow from the river. Tom O’Donnell owned shares in Whitewater, which irrigated his golf course…

    At the south end of the Coachella Valley, there was an even more ambitious ditch-digging project, rivaled only by Mulholland’s Los Angeles aqueduct. Starting in 1900, the California Development Company constructed hundreds of miles of irrigation ditches and canals to bring water from the Colorado River to the arid desert and create fertile farmland out of the Salton sink. At first the effort worked, but it lasted for only a few years until the silt-laden Colorado water clogged the canal.

    After a prodigious rainfall in 1905, a breach in the walls of the canal caused the entirety of the river to flow into the sink for the next two years while workers frantically worked on repairs. This tinkering with nature resulted in the Salton Sea.

    Colorado lawmakers gave final approval Friday to a $30.5 billion state budgetpackage that includes $300 million for road projects, $175 million for full-day kindergarten and a 3% pay hike for all state employees.

    The agreement on the spending plan that starts July 1 came after the budget writers found an extra $70 million for transportation as part of a deal with Republican lawmakers who threatened to obstruct the debate.

    The additional dollars will come from a variety of sources, including $40 million out of two reserve accounts. The state’s push for full-day kindergarten took a $10 million cut because fewer students are expected to participate. And the remaining $20 million came from unspent dollars and minor accounting tweaks.

    The original budget package allocated $230 million for roads. The new $300 million total — which will require additional legislation this session — would get split between the state and local governments for highway construction, mass transit projects and road maintenance. The total need for transportation in Colorado is estimated near $9 billion.

    State Rep. Chris Hansen, a Denver Democrat and budget writer, said the budget package boosts spending in key areas, such as education and road building. “We are making historic investments across the areas we care about,” he told lawmakers…

    The House approved the final budget bill by a 41-22 vote with only one Republican in support, state Rep. Lois Landgraf of Fountain. The Senate later voted 25-7 on the bill with a handful of Republican lawmakers in favor.

    The budget bill now goes to Gov. Jared Polis for consideration. The governor has line-item veto authority to strike items in the budget bill.

    Science Magazine: Concerns of young protesters are justified #ActOnClimate

As scientists and scholars who have recently initiated similar letters of support in our countries, we call for our colleagues across all disciplines and from the entire world to support these young climate protesters. We declare: Their concerns are justified and supported by the best available science. The current measures for protecting the climate and biosphere are deeply inadequate…

    It is critical to immediately begin a rapid reduction in CO2 and other greenhouse gas emissions. The degree of climate crisis that humanity will experience in the future will be determined by our cumulative emissions; rapid reduction now will limit the damage. For example, the Intergovernmental Panel on Climate Change (IPCC) has recently assessed that halving CO2 emissions by 2030 (relative to 2010 levels) and globally achieving net-zero CO2 emissions by 2050 (as well as strong reductions in other greenhouse gases) would allow a 50% chance of staying below 1.5°C of warming. Considering that industrialized countries produced more of and benefited more from previous emissions, they have an ethical responsibility to achieve this transition more quickly than the world as a whole.

    The basic explanation for why CO2 and other greenhouse gases warm the planet is so simple and has been known science for more than a century. Our atmosphere is transparent to visible light — the rainbow of colors from red to violet that make up natural sunlight. When the sun shines, its light passes right through the atmosphere to warm the Earth.
    The warm Earth then radiates some of its energy back upward in the form of infrared radiation — the “color” of light that lies just beyond red that our eyes can’t see (unless we’re wearing infrared-sensitive night-vision goggles). If all of that infrared radiation escaped back into space, the Earth would be frozen solid. However, naturally occurring greenhouse gas molecules, including not just CO2 but also methane and water vapor, intercept some of it — re-emitting the infrared radiation in all directions, including back to Earth. That keeps us warm.
    When we add extra greenhouse gases to the atmosphere, though, we increase the atmosphere’s heat-trapping capacity. Less heat escapes to space, more returns to Earth, and the planet warms.

    The U.S. Senate on Thursday confirmed Colorado native David Bernhardt as secretary of the Interior Department.

    Colorado’s Republican U.S. Sen. Cory Gardner was a “yes” vote while Michael Bennet, his Democratic counterpart, was a “no.”

    Bernhardt’s nomination cleared the chamber by a 56-41 vote.

    Bernhardt, from Rifle, worked as an oil and gas lobbyist before he was initially tapped to be the Interior’s No. 2 official.

    When former Secretary Ryan Zinke resigned last year, Bernhardt was chosen to be the agency’s interim leader. In February, President Donald Trump picked him as Zinke’s permanent replacement.

    Democrats and environmental groups have lambasted Bernhardt as being too close to drilling interests. Kelly Nordini, executive director of Conservation Colorado, said Thursday that letting Bernhardt lead the Interior is like “letting the fox guard the henhouse.”

    Bennet previously supported Bernhardt’s nomination as deputy secretary of the Interior in July 2017, but switched his vote this time around citing Bernhardt’s support of drilling in the Arctic National Wildlife Refuge. He said the earlier decision “is a vote I regret.”

    “The Zinke ethics hurricane was bad enough. America should not be harmed again by a Bernhardt ethical typhoon,” said Sen. Ron Wyden, an Oregon Democrat.

    Citing figures from the Office of Government Ethics, Wyden said at least 27 former clients representing the oil and gas industry, coal, water districts and agriculture pose “unlimited numbers of conflicts of interest” for Bernhardt.

    Republicans say Bernhardt is well-prepared for the job. “David knows how important public lands are to our state and has a keen understanding of the issues Coloradans face every day,” Gardner said in an earlier statement.

    The April 1 forecast for the April – July unregulated inflow volume to Blue Mesa Reservoir is 925,000 acre-feet. This is 137% of the 30 year average. Snowpack in the upper Gunnison River basin is currently 132% of average. Blue Mesa Reservoir current content is 259,000 acre-feet which is 31% of full. Current elevation is 7440 feet. Maximum content at Blue Mesa Reservoir is 829,500 acre-feet at an elevation of 7519.4 feet.

    Black Canyon Water Right
    The peak flow and shoulder flow components of the Black Canyon Water Right will be determined by the May 1 forecast of the April – July unregulated inflow volume to Blue Mesa Reservoir. If the May 1 forecast is equal to the current forecast of 925,000 acre-feet of runoff volume, the peak flow target will be 6,513 cfs for a duration of 24 hours. The shoulder flow target will be 915 cfs, for the period between May 1 and July 25. The point of measurement of flows to satisfy the Black Canyon Water Right is at the Gunnison River below Gunnison Tunnel streamgage at the upstream boundary of Black Canyon of the Gunnison National Park.

    Aspinall Unit Operations ROD
    Pursuant to the Aspinall Unit Operations Record of Decision (ROD), the peak flow and duration flow targets in the lower Gunnison River, as measured at the Whitewater gage, will be determined by the forecast of the April – July unregulated inflow volume to Blue Mesa Reservoir and the hydrologic year type. At the time of the spring operation, if the forecast is equal to the current forecast of 925,000 acre-feet of runoff volume, the hydrologic year type will be set as Moderately Wet. Under a Moderately Wet year the peak flow target will be 14,350 cfs and the duration target at this flow will be 10 days. The duration target for the half-bankfull flow of 8,070 cfs will be 20 days. The criteria have been met for the drought rule that allows half-bankfull flows to be reduced from 40 days to 20 days.

    Projected Spring Operations
    During spring operations, releases from the Aspinall Unit will be made in an attempt to match the peak flow of the North Fork of the Gunnison River to maximize the potential of meeting the desired peak at the Whitewater gage, while simultaneously meeting the Black Canyon Water Right peak flow amount. The magnitude of release necessary to meet the desired peak at the Whitewater gage will be dependent on the flow contribution from the North Fork of the Gunnison River and other tributaries downstream from the Aspinall Unit. Current projections for spring peak operations show that flows in the Gunnison River through the Black Canyon could be over 7,500 cfs for 10 days in order to achieve the desired peak flow and duration at Whitewater. With this runoff forecast and corresponding downstream targets, Blue Mesa Reservoir is currently projected to fill to an elevation of around 7500 feet with an approximate peak content of 660,000 acre-feet.

    Unit owners of the Colorado-Big Thompson project, which delivers Colorado River water from the wet Western Slope to the dryer Front Range, will get 70% of their quota this year, according to a Northern Water news release.

    The 70% allocation means that a farmer who owns 10 acre-feet of Colorado-Big Thompson water will get seven in a year, with the remaining three kept in storage for use in dry years…

    In wet years like this one, Northern sometimes downsizes the quota of Colorado-Big Thompson water distributed, since native streams can be full enough to provide farmers late-season growing supply, which provides Northern a storage opportunity for use in dry years.

    But the move to boost the Colorado-Big Thompson quota from 50% — the level normally set at the start of Northern’s water year in November just to get users through the winter so snowfall can inform spring allocation rates — ensures farmers will have a more flexible late growing season.

    The quota increases available Colorado-Big Thompson water supplies by 62,000 acre-feet from the initial 50% quota made available in November…

    The snow-water equivalent mark for the Upper Colorado Basin is 120% of the normal median as of Thursday, according to the U.S. Bureau of Reclamation, with snowpack levels in other river basins across the southwest at even higher marks. But KUNC and The Aspen Times reported this year that despite the good snowfall this winter, officials predict spring runoff won’t be enough to replenish reservoirs across the southwest, because years of drought have left dry soil that sucks up extra drops.

    “Modeled soil moisture conditions as of November 15th were below average over most of the Upper Colorado River Basin and Great Basin,” the Colorado Basin River Forecast Center stated in its April 1 report. “In the Upper Colorado River Mainstem River Basin, soil moisture conditions were below average in headwater basins along the Continental Divide, and closer to average downstream.”

    Water from the Colorado-Big Thompson project supplements other sources for 33 cities and towns, 120 agricultural irrigation companies, various industries and other water users within Northern Water’s 1.6 million-acre service area, across parts of eight counties, the Northern release said.

    City of Thornton Larimer County 1041 permit update

    The city of Thornton plans to sue Larimer County over commissioners’ rejection of the Thornton pipeline proposal, according to the county’s attorney.

    Larimer County attorney Jeannine Haag told the Coloradoan she learned Thornton would be filing a lawsuit when she called the city’s attorney and asked whether the city would pursue legal action contesting the pipeline decision.

    Thornton will file a lawsuit in Larimer County District Court next week, Haag said. Thornton spokesman Todd Barnes told the Coloradoan the city doesn’t comment on issues of potential litigation…

    Thornton officials have kept quiet about their plans since commissioners unanimously rejected their proposal to build a pipeline to carry Poudre River water through Larimer County. Thornton leaders said they wouldn’t decide what to do until they could review commissioners’ written explanation of the vote. Commissioners approved that document March 18…

    It was also possible that Thornton officials would pursue an agreement with the city of Greeley, which has extra capacity in a water pipeline that might have been useful for Thornton. The cities met on the matter last month.

    In the written explanation of their decision on the pipeline, Larimer County commissioners said Thornton didn’t meet eight of the 12 criteria for the 1041 permit required to build the pipeline. The commissioners’ ruling was the county’s first-ever rejection of a 1041 permit.

    Commissioners wrote that Thornton didn’t meet the following criteria:

  • The proposal is consistent with the county’s master plan for land use and development
  • The applicant presented reasonable siting or design alternatives or explained why no reasonable alternatives are available
  • The proposal conforms with county standards and mitigation requirements for environmental impacts
  • The proposal won’t have a significant adverse effect on the land on which it’s situated and adjacent land, or will adequately mitigate significant adverse effects
  • The proposal won’t negatively impact public heath and safety
  • The benefits of proposed development outweigh the losses of any natural resources or resulting reduction of productivity of agricultural lands
  • The proposal demonstrates a reasonable balance between the costs to the applicant to mitigate significant adverse effects and the benefits achieved by that mitigation

    Over the last few years, residents of the western Colorado town of Paonia, the longtime headquarters of High Country News, have planted yard signs, skipped ultimate frisbee to attend public meetings, and embarrassed themselves and each other during a karaoke-themed fundraiser — all in the name of preventing oil and gas development in their watershed. Despite their efforts, the Bureau of Land Management and Forest Service approved major fracking projects, in 2015 and 2017, just above this small community, where agritourism and a renewable energy training facility are growing as coal jobs fade.

    What public pushback didn’t stop, a federal court in Denver has temporarily halted. In late March, Colorado U.S. District Judge Lewis Babcock ruled the agencies failed to fully consider climate and wildlife impacts in approving the projects, and ordered them to rework their environmental reviews. It is the latest in a string of decisions regarding federal environmental planning for oil and gas development and leasing on public lands. Another judge also recently rejected oil and gas leases in Wyoming, citing an inadequate analysis of how they would harm the climate; together, the rulings have blocked development approved by both the Obama and Trump administrations.

    Environmentalists see the decisions as major victories and an opportunity to slow down the “energy dominance” agenda of the Trump administration. At the same time, they’re aware that courts alone can’t prevent the administration from increasing leasing and drilling on public lands. But in the details of the decisions, and in growing public awareness and activism around climate action, they see a chance to slow or stop oil and gas development on public land.

    The courts are merely delaying, rather than actually preventing fossil fuel development over climate concerns. That’s because the National Environmental Policy Act of 1970 (NEPA) governs process, not outcomes. The law requires disclosure, “but NEPA doesn’t have the kind of teeth to force agencies to act on climate change,” said Clare Lakewood, a lawyer for the Center for Biological Diversity. “Practically speaking, (BLM) will do the analysis the court directed,” and likely continue with the fracking project in western Colorado, said Laura King, a lawyer for the Western Environmental Law Center. Steven Hall, the BLM Colorado communications director, said the agency will work with the groups that sued to address the issues identified by the court.

    While it would be foolhardy to expect the Trump administration to change its plans based on a climate analysis, just a few years ago the Interior Department appeared to be taking climate change more seriously. In 2016, Interior Secretary Sally Jewell issued a moratorium on federal coal auctions and initiated an environmental review of the entire federal coal-leasing program. Though that review was never completed — and the moratorium was overturned in short order by Trump’s then-secretary, Ryan Zinke — the data collected during it were published late last year in a report by the U.S. Geological Survey. That report shows that the extraction and combustion of fossil fuels from federal lands is responsible for approximately one-fourth of the carbon dioxide emissions produced in the United States.

    The report not only showed that federal lands are a major contributor to climate change, it also demonstrated that tools exist to track and estimate how they contribute to greenhouse gas emissions. Now, federal judges are keen to see those tools employed to inform agency decision-making. In a ruling that is delaying 303,000 acres of oil and gas leases in Wyoming, U.S. District Judge Rudolph Contreras wrote that by omitting analysis of the cumulative impacts of greenhouse gas emissions, the BLM failed to abide by environmental laws. He also wrote, “BLM could decline to sell the oil and gas leases at issue here if the environmental impact of those leases — including use of the oil and gas produced — would not be in the public’s long-term interest.”

    The judge’s assertion is critical for activists who want to keep fossil fuels in the ground. The Interior Secretary is directed by law to hold quarterly oil and gas lease sales. But if the BLM has the power to decline to issue the leases based on their ultimate contribution to climate change, that could pave the way for future administrations to phase-out or even eliminate fossil fuel leasing on public lands. “We think the agencies have complete discretion,” to issue a moratorium on new federal fossil fuel leasing, said Jeremy Nichols, the climate and energy program director for WildEarth Guardians.

    Climate action is not coming from the current partisan Congress, an Interior Department led by former industry lobbyists, or a president who blames wind turbines for cancer while praising the beauty of coal. But recent court decisions are giving future administrations a legal footing to phase out fossil fuel development on public lands, and bolstering environmental activists like the karaoke-singers in Paonia by posing an important question: Is fossil fuel development a sensible way to manage public land for future generations?

    Giddy would not necessarily be too strong of a description of the mood at the National Weather Service in Salt Lake City, where water managers, hydrologists and storm forecasters and others reviewed the current mountain snowpack and talked of more moisture to come.

    “It’s been a pretty good snowpack year,” said Troy Brosten, Utah Snow Survey supervisor with the U.S. Department of Agriculture’s Natural Resources Conservation Service.

    During a briefing [April 9, 2019], Brosten pointed to snowpack numbers across the state that are anywhere between 104 percent of average to a whopping 197 percent of average in southeastern Utah, which was bone-dry last year and bore one of the country’s most significant drought designations.

    Except for a thin slice across the top half of the state, which is still termed dry, the precipitation over the last few months has eliminated any drought classification in Utah, said Brian McInerney, senior hydrologist with the National Weather Service in Salt Lake City.

    February and March were phenomenal months for building snowpack, and the storm that swept into the state Tuesday and will linger into Thursday marks the beginning of a wet, cool pattern predicted to last through the month.

    “It will be active, unsettled and colder than normal,” said Glen Merrill, meteorologist with the National Weather Service in Salt Lake City.

    The stormy pattern will just add to the snowpack, and water watchers are now shifting into a different mode, keeping eyes on reservoirs as the stormy weather continues…

    With the exception of Red Fleet, which struggled with low flows, and Strawberry — which is huge — the state’s reservoirs should fill, Henrie said.

    The other notable exception is Lake Powell, impacted by a near 20-year drought on the Colorado River. Henrie said these April storms will give it a good boost, but it will take many good hydrological years to recover.

    Henrie noted that a few months ago he didn’t think he’d be paying much attention to the charts showing how quickly reservoirs are beginning to fill, but the storms changed that.

    Ideally, the snowpack comes off in an orderly fashion — but McInerney said what is to come in May is anybody’s guess at this point.

    According to a press release from Pagosa Area Water and Sanitation District Manager Justin Ramsey, the recorded snow water equivalency (SWE) totals have dropped .01 inches, going from 40.6 inches las week to 40.5 inches this week.

    Overall precipitation, though, has increased from last week, going from 39.1 inches to 43.2 inches.

    The SWE median has increased, going from 30.2 inches to 31.6 inches this week.

    Since Jan. 28, the SWE percent- age of median has increased each week; however, that trend came to an end this week with a reported drop of 6.2 inches, going from 134.4 percent of median last week to 128.2 this week.

    The precipitation percentage of average has increased from last week, going from 121.4 percent of median to 127.8 percent of median.

    The precipitation average is currently 33.8 inches, when last week it was 32.2 inches.

    “The good news is the SWE is well above average, the bad news is, it does appear we hit the peak on March 23rd 18 days earlier than the average peak SWE,” the press release states…

    For lake levels, four of the five lakes measured are full this week, with the exception of Stevens Lake, which is 72 inches from full.

    Hatcher Lake, Lake Pagosa, Vil- lage Lake and Lake Forest are all noted as being full this week.

    Last week, Lake Pagosa, Village Lake and Lake Forest were all full while Hatcher Lake was 16 inches from full and Stevens Lake was 103 inches from full.

    Ramsey explained that all the lakes that are full were made full from precipitation…

    Total cumulative available lake water for treatment and delivery this week sits at 90.6 percent when last week that total was 86.3 percent.

    Total diversion flows remain at 5 cubic feet per second (cfs), with the West Fork and Four Mile diversions contributing 2 and 3 cfs, respectively.

    Four Mile flows are still being diverted into Stevens, the press release notes.

    From March 22 through March 28 this year, water production totaled 13.17 million gallons. Last year during that same time, water production was listed at 10.29 mil- lion gallons.

    From March 22 through March 28 of this year, the Snowball water treatment plant produced 3.79 million gallons, while the Hatcher water treatment plant produced 9.38 million gallons.

    From March 15 through March 21 of this year, water production was recorded at 13.43 million gallons.

    Summary

    After a dry March, a series of storms brought much needed precipitation to the Pacific Northwest, staving off further degradations in Washington and resulting in local flooding and broad drought improvements in Oregon. Elsewhere, the West remained largely status quo with the only degradation in drought conditions occurring in the Big Horn Mountains where snowpack has been well below normal all winter. The South and Southeast saw a mixture of improvements and degradations. Locally heavy rainfall brought improvements to parts of Texas, Louisiana, and the Carolinas while areas such as southeastern Alabama saw an expansion of moderate drought. Much of the remainder of the country remains largely free of drought and abnormal dryness…

    High Plains

    Precipitation across the High Plains was generally near normal over the last week, with the exception of northeast Nebraska and southeast South Dakota. Temperatures were warmer than normal in all but eastern North Dakota. Temperatures ranged from 3 degrees below normal in Grand Forks to 14 degrees above normal in the Nebraska Panhandle. No changes were made to the map this week and the area remains free of drought and abnormal dryness…

    West

    With the exception of Wyoming, conditions in the West improved or maintained status quo. A series of storms brought heavy rain and mountain snow to the Pacific Northwest resulting in the elimination of abnormal dryness in northern California and a one-category improvement over much of Oregon. While Washington also received beneficial rains, the amounts were not sufficient to put a dent in the long-term deficits and drought emergencies still exist in several river basins. Elsewhere, reductions in abnormal dryness also occurred in western Idaho, and in northern and east-central Nevada. Moderate drought conditions developed in the Big Horn Mountains of Wyoming where snowpack has been low all winter…

    Looking Ahead

    By the time of this map’s release, a powerful storm will be impacting much of the U.S., bringing heavy rain and mountain snow to the West; blizzard conditions, flooding rain, and severe weather to the Plains and Midwest; and showers and thunderstorms to the South. Behind the storm, parts of the Southern High Plains in Texas and New Mexico will experience fire weather conditions as very dry air and high winds affect the region. As the storm progresses eastward, parts of the Northeast are expected to see rainfall by the end of the week. Another system moving towards the West Coast this weekend is expected to bring low elevation rain and mountain snow to the Pacific Northwest and Intermountain West over the coming week. If the forecast verifies, next week’s map could see additional improvements to drought areas in the Northwest and South.

    As of the beginning of April, snowpack in the Upper Colorado River basin sits at 130 perfect of normal. Snowpack conditions are well above where they were a year ago when we were wondering if western Colorado rivers would be boatable at all. Accumulating abundant snowpack over the course of the winter is important because it represents a temporary savings account that will be drawn upon for the remainder of the spring, summer and fall. his savings account provides our everyday drinking water, irrigation water for agricultural, in-channel flows that support fish and other wildlife, and the water we enjoy for river recreating.

    Mother Nature, however, is largely in control of how quickly the water savings account is drawn down. As snow melts in the high country, the runoff makes its way down the rivers and streams of the Western Slope, with peak flow typically occurring during the months of May and June in the Colorado River. The timing of peaking flows and the volume of water that finds its way to rivers and streams is influenced by a number of factors. Conventional wisdom is that warm air temperatures and sunny days have a strong influence on the rate of snowmelt. Newer evidence is showing that human-induced factors are starting to shift historic patterns.

    Researchers from Colorado State University have found that the timing and volume of runoff in the Colorado River is shifting due to higher temperatures now common in the basin, a result of human caused climate change. The phenomena of dust on snow, or the accumulation of blowing dust that settles on the surface of the snowpack, can also play a role by melting snow earlier.

    Because of ongoing drought conditions and the notable lack of precipitation in 2018, soil moisture content in the Upper Colorado going in to the winter months ranged from 70 percent below average to less than 30 percent below average. Melting snow will need to replenish soil moisture before runoff occurs. In addition, many of the state’s reservoirs were depleted after the low water year of 2018. The net effect of these influences could mean a reduced peak streamflow and an overall reduced volume of water.

    Nonetheless, there is plenty of reason to enjoy the bounty of this year’s anticipated runoff.

    Once signed into law, the legislation will authorize the implementation of the Drought Contingency Plan agreements forged between the seven Colorado River Basin states and Native American tribes.

    “Tens of millions of people in the western United States rely on the Colorado River to provide water for agricultural, municipal, and consumptive use, as well as support for our growing recreation economy,” Gardner said.

    The Drought Contingency Plan enjoys widespread support in Colorado, including from the state and multiple Front Range and Western Slope water utilities.

    “The Colorado River is the lifeblood of our economy, but in recent years we’ve experienced some of the worst drought conditions in centuries,” Bennet said. “Passing the Drought Contingency Plan is a win for the millions of people across the West who rely on the Colorado River.”

    Butrón-Méndez lives nearby and works for the conservation group Pronatura Noroeste as a bird monitor…

    He cuts the motor in an open stretch of water he calls the “scary lagoon,” ringed by tall grasses that rise from the thigh-high water. Without the boat’s droning hum, coastal birds appear over the reeds, and come in for a water landing.

    American coots, with their white bills and dark grey feathers, cackle as they swim. They’re interspersed among broad-winged, yellow-beaked pelicans. Other birds, just silhouettes, dart along the surface, skimming for insects before dark. There’s no sign of them tonight, but several species of threatened or endangered marsh birds — like the Ridgway’s rail — call this place home too…

    Butrón-Méndez has explored this wetland since its creation, watching over the course of decades as the shape-shifting oasis was born.

    “Water started to flow to this place in the 1970s. I would walk around here without having to worry about getting wet,” Butrón-Méndez said though a translator. “If there wasn’t water, it’s a dry place.”

    He’s been called the Ciénega’s patron saint, able to rattle off its history and the names of the birds, fish and mammals that live here.

    The wetland is fed by a concrete canal that removes drainage water from American farms across the border in Arizona. The canal is called the MODE — Main Outlet Drain Extension. The salty runoff inadvertently created this oasis in the middle of the Sonoran desert, a perfect stopover for migratory birds on their journey along the Pacific coast…

    But there’s a problem. As the Colorado River basin heats up and dries out like climate projections predict, Butrón-Méndez is concerned people will stop thinking of the water that flows to the wetland as waste, find a way to use it and, in turn, harm the Ciénega…

    Wasted water

    The Ciénega was born in 1977 when the U.S. began draining salty agricultural runoff to the Santa Clara slough, near the Gulf of California. Years prior, the U.S. agreed not to send degraded water to Mexico, a near-constant tension between the two countries since they signed their first Colorado River treaty in 1944.

    In a 1973 agreement called the “Permanent and Definitive Solution to the International Problem of the Salinity of the Colorado River,” President Richard Nixon’s administration agreed to a limit on how salty water would be at when delivered at the U.S.-Mexico border.

    To keep the river from becoming loaded with salt, someone had to devise a way to keep the farm runoff from ending up in it. That’s how the MODE canal came to be. After irrigating lettuce fields and date palms in salty soil near Yuma, Arizona, the concrete-lined MODE would take the leftover water across the border close to the Pacific Ocean to dispose of it.

    No one meant to create a haven for birds and other wildlife in the dried-out Colorado River delta in the process. But by sending about 100,000 acre-feet of water annually out into the desert, that’s what happened…

    The wetland does have some protections. The Mexican government has designated the Ciénega as a Biosphere Reserve in the Colorado River Delta. It’s also been recognized for having “great ecological significance” by the Ramsar convention, an intergovernmental treaty on the value of wetlands. If the U.S. were to run the Yuma Desalting Plant it would likely trigger a reconsultation of previous agreements between the two countries.

    This past March will go down in the record books for Arapahoe Basin Ski Area, Breckenridge Ski Resort, Copper Mountain Resort and Keystone Resort, which all received more March snowfall than ever before.

    At Breckenridge, spokeswoman Sara Lococo said March’s 111 total inches surpassed the previous high of 98 inches that Breckenridge received in March 2001. That’s 13.3 percent more snow than March 2001. The 111 inches also makes March 2019 the third snowiest month on record at Breckenridge and the snowiest month outside of a pair of Januarys. The highest monthly snowfall total on record for the resort was 120 inches in January 2014, followed by 112 inches in January 1996.

    At Copper Mountain, spokeswoman Taylor Prather said March 2019’s 98 inches of snow was just about 14 percent more snowfall than Copper’s previous March high, the 86 inches the resort received in March 2001. This past month also ranks as the fourth snowiest month on record since the resort opened in 1972. It’s also the second snowiest month of this past decade.

    At Keystone, March’s 94 inches of snow was just under 19 percent more snow than the previous record March: March 2011’s 79 inches of snow. March 2019 comes in as the third snowiest month on record at Keystone, only behind the 128 inches received in December 1983 and the 127 inches that fell in January 1996.

    And up at the Continental Divide, Arapahoe Basin Ski Area received 82.75 inches this March. Though it was the snowiest month yet this year for the ski area, and though A-Basin’s annual average for March is 51 inches, A-Basin’s all-time record for March snowfall was the 110 inches that fell in March 1982.

    A-Basin spokeswoman Katherine Fuller said April is actually, on average, the snowiest month of the year, at 53.4 inches. Fuller clarified that A-Basin’s data goes back to 1978. In that time, Fuller said A-Basin has had multiple 100-plus-inch months, led by December 1983’s 133 inches.

    This March was one of the snowiest ever in the past 84 winters in Aspen, but it didn’t set a record.

    The Aspen Water Treatment Plant recorded 63.1 inches of snow this month. The record is 76.50 inches in March 1965. The city of Aspen has snow and precipitation records back to the 1934-35 winter.

    “The snowfall we did receive was relatively high in moisture and the total precipitation was record-breaking,” said the water treatment plant’s monthly report, filed by Laura Taylor. “6.04 inches was measured, surpassing the old record of 5.53 inches from March 1995.”

    The records confirm what everyone probably suspected. The month was way above the average for precipitation, which is 2.38 inches, and it also was well above the average of 27 inches of snow at the water plant…

    For the month of March, Aspen Highlands collected 117 inches of snow. Snowmass hauled in 96 inches and Aspen Mountain logged 95.

    That was the third-snowiest March in 24 years of records at Snowmass, according to Hanle. There were 119 inches logged in March 1995 and 100 inches in 2008.

    For the season from Nov. 1 through March, Aspen Highlands scored 338 inches of snow. Snowmass was a close second at 313 inches.

    Aspen Mountain collected 253 inches from November through March while Buttermilk recorded 143 inches.

    The season-to-date snowfall amounts are running about 20 percent above average for the ski areas, Hanle said.

    Thanks to the 7.1 inches of snowfall from the bomb cyclone, Denver finished its typically snowiest month of the year with an above-average total. The 12.9 inches of total March snowfall made it the snowiest March since 2016, when another big blizzard jacked up monthly totals. With February snapping Denver’s 25-month below-average snowfall skid, seasonal snow totals have recovered to near-typical levels for the beginning of April, although Denver’s official snowfall is still slightly below normal.

    This is a continuation of what’s been an active winter overall for the Front Range and statewide. All three months so far in 2019 have finished with above-average precipitation in Denver, helping wipe away most of Colorado’s drought.

    The #RepublicanRiver Water Conservation District meeting tomorrow includes public hearing on new water use fee policy

    A public hearing on the proposed new water use fee policy will be held during the Republican River Water Conservation District Board of Director’s regular quarterly meeting next week in Yuma.
    The meeting will be Thursday, April 11, in the banquet room at Quintech, 529 N. Albany St., beginning at 10 a.m.

    The public hearing on the proposed water use fee policy will be at 1 p.m.

    The new water use fee policy establishes and corrects water use fees for non-groundwater irrigation use in accordance with the Republican River Compact Administration accounting procedures and reporting requirements. It includes fees for all water uses, including junior surface water rights “as each water use affects compact compliance” according to the meeting release from the RRWCD.

    A copy of the six-page proposed policy can be found on the district’s website, http://www.republicanriver.com.

    It states that the policy is intended to provide a fair and equitable fee structure for all types of water use and consumption. The fees are set at a level to fund the necessary programs of the RRWCD “intended to meet the statutory responsibilities and limitations of the District.” It will not impact water use that was decreed or permitted earlier than December 31, 1942, prior to the Republican River Compact.

    Water users that have a decreed plan for augmentation that replaces depletions will not be assessed a fee for that water use and consumption.

    General public comment will be heard immediately following the public hearing on the proposed policy.

    Among the presentations to be made at the April 11 meeting is one by Margaret Lenz regarding the Yuma County Conservation District soil moisture monitoring program.

    The board will discuss and vote on sending comments regarding the new proposed WOTUS Rule. It also will discuss and vote on an agreement to offer well owners who are required to provide an augmentation plan to another river basin.

    It will receive reports from the general manager, the compact compliance pipeline operator, from chairmen fo the RRWCD committees, the RRWCD’s engineer, federal and state lobbyists and legal counsel. The board also will receive a report by the State Engineer’s Office and discuss South Fork Water Rights.

    I’m pleased that collaborative efforts among the seven Colorado River Basin states, local water agencies, Tribes, non-governmental organizations, Mexico and the Department of the Interior to reduce risk on the Colorado River are succeeding. I applaud Congress for taking prompt action on implementing legislation for the Drought Contingency Plans. This brings us one step closer to supporting agriculture and protecting the water supplies for 40 million people in the United States and Mexico. Working together remains the best approach for all those who rely on the Colorado River.

    Legislation for the drought contingency plan aimed at propping up Lakes Mead and Powell unanimously cleared the House and Senate Monday and Tuesday, respectively. The bill now heads to President Trump for his signature.

    The plan calls on the Lower Colorado River Basin states of Arizona, California and Nevada to conserve up to 1.2 million acre-feet of the 7.5 million acre-feet to which they have a right between now and 2026. The cuts will kick in at small amounts almost immediately and will escalate when Lake Mead drops low enough.

    Arizona, whose $4 billion Central Arizona Project will take the first cuts during a Colorado River shortage, would lose 192,000 acre-feet of CAP water at first. (One acre-foot is enough water to serve four Tucson households for a year.)

    When Lake Mead drops below 1,075 feet, which could happen by 2021, the CAP would lose nearly one-third of its supply, or 500,000 acre-feet. When Mead hits 1,025 feet, the CAP would lose more than 700,000 acre-feet.

    The plan is aimed at delaying the time when the two reservoirs will drop so low that it will be difficult or impossible to get water and electric power from them.

    Rep. Raúl Grijalva, a Tucson Democrat whose bill is the one headed to the White House, praised its passage but warned in an interview that it’s only an interim step.

    The seven Colorado River basin states must soon start work on revising guidelines for managing the river that were approved in 2007 and expire in 2026…

    This was “a remarkable chapter in the long story of securing Arizona’s water supplies,” said Arizona Department of Water Resources Director Tom Buschatzke.

    In congressional testimony last month, Buschatzke acknowledged the plan isn’t a permanent solution: “We recognize that more must be done by the states to prepare for a drier future.”
