NARROW WOTUS ON HOLD IN CO

The adoption of narrower Clean Water Act protections for streams and wetlands is currently blocked in Colorado, as a result of a court ruling on the state’s challenge to the new federal rule. Details are in this Bloomberg Law report.

These wetlands, located on a 150-acre parcel in the Homestake Creek valley that Homestake Partners bought in 2018, would be inundated if Whitney Reservoir is constructed. The Forest Service received more than 500 comments, the majority in opposition to, test drilling associated with the project and the reservoir project itself.
